2. Website Content & Intellectual Property
All content on the Site — including text, copy, graphics, page designs, layouts, code samples, case studies, images, and the selection and arrangement of all of the above — is the property of Kyveon or its licensors and is protected by United States and international copyright laws.
You may view, download, and print pages from the Site for your own internal business evaluation of our services. You may not, without our prior written consent:
- Copy, reproduce, republish, or redistribute Site content for commercial purposes;
- Use our case studies, portfolio descriptions, or client results in your own marketing;
- Create derivative works from the Site's design, copy, or code;
- Remove or alter any copyright, trademark, or proprietary notices.
3. Trademarks & Brand
The KYVEON name, logo, wordmark, and the tagline "We Build. You Grow." are trademarks of Kyveon. Nothing on the Site grants any license or right to use them without our prior written permission. Third-party names and logos appearing on the Site (such as technology platforms we work with) are the trademarks of their respective owners, are used for identification only, and do not imply endorsement, sponsorship, or affiliation.
4. User Conduct
When using the Site, you agree that you will not:
- Use the Site for any unlawful purpose or in violation of any applicable law;
- Scrape, harvest, or collect data from the Site by automated means, including for training machine-learning models, without our written consent;
- Attempt to gain unauthorized access to the Site, its servers, or connected systems;
- Interfere with the Site's operation, including by transmitting malware, flooding, or denial-of-service activity;
- Submit false, misleading, or fraudulent information through our contact forms;
- Impersonate Kyveon, its founder, or any other person or entity.
We may suspend or block access to the Site for conduct that violates this Section.
5. Client Engagements
The Site describes our services, indicative pricing, and process for general information. Prices shown are "starting from" figures and do not constitute a binding offer; every engagement is quoted individually. Professional services are governed exclusively by our Master Services Agreement and the applicable Statement of Work — not by these Terms.
6. Service Descriptions & Results
Kyveon provides web development and mobile application development services. Service descriptions, package contents, and portfolio content on the Site are informational and may change without notice. Deliverables may depend on third-party platforms, hosting providers, app stores, and APIs whose availability, performance, and pricing are outside Kyveon's control. Any results, conversion figures, rankings, time savings, or statistics described on the Site reflect specific past engagements and are not a guarantee of future results. Professional engagements are governed by our Master Services Agreement.
7. Third-Party Links
The Site links to third-party websites and services (e.g., GitHub, LinkedIn). We do not control and are not responsible for their content, policies, or practices. Linking does not imply endorsement. Your use of third-party services is at your own risk and subject to their terms.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYVEON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KYVEON'S TOTAL AGGREGATE LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law. Liability arising from paid professional services is governed by the Master Services Agreement, not this Section.
10. Indemnification
You agree to indemnify and hold harmless Kyveon and its founder, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site that is not subject to arbitration under a separate agreement will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
